The use of the website and the purchase of any goods or products from the website is governed by these terms and conditions. We reserve the right to modify these terms and conditions without notice to you.

Your acceptance of the Terms and Conditions is given when you make a successful purchase of goods from this website, so please read them carefully before making a purchase.

We reserves the right to change these Terms and Conditions at any time and any such change will be effective to all new orders once included in the text of these Terms and Conditions and published on the website.

Nothing in these terms and conditions affects your statutory rights as a consumer.

Making a purchase from Jo Brown Curtains & Blinds

Your submission of an order on the this website represents an offer to purchase Goods and/or Products by you and it is not binding on us until we have notified you that the order is accepted. When we receive an order we will send you an order confirmation email to confirm receipt. The order confirmation email does not constitute acceptance of your offer(s) to purchase goods, acceptance is only confirmed when a shipping confirmation is sent.

The website price calculators take into account as many factors as possible but the nature of made-to-order production using furnishing fabrics with variations in fabric widths, pattern repeats, half-drops, material type, etc means that on occasion it may be necessary to amend a system calculated price prior to acceptance of the order. This would be advised prior to production and the customer will have the right to cancel at that point and receive a full refund. 

The contract with you is formed when that shipping confirmation is sent.

Any communications made by us until your order is accepted by us do not indicate acceptance. This means that if Goods or Products are shown on the site but are unavailable, incorrectly priced or incorrectly described, we will not be obliged to sell you those goods.

We try to ensure that all information and data presented on the website such as prices, images, descriptions and stock availability are accurate and correct at the time of viewing and purchase. We will try to resolve all information and data errors on the website as soon as reasonably possible, however we will not be liable for any errors on the website and will not be obliged sell you any goods affected by such an error.

The packaging of the product may vary from the images shown on the website and the packaging colours also may vary slightly from your screen image.

Please note that all goods on the website are subject to availability we may not be able to supply your order. 

Changes or cancellation of order requests can only be made within 20 minutes of submitting the order as all orders are processed promptly. We do not guarantee that amendments and cancellations can be completed before dispatch, though every effort will be made to do so during customer service working hours of 9am-6pm Monday to Friday. Amendments and cancellations cannot be processed after the order has been accepted and has been shipped. See returns information below.

We must receive full payment before we can accept your request for an order and please note that we process the payment of order on receipt of card details. Your order will only be confirmed as accepted by us when we despatch that product to you and send you a shipping confirmation email.

We reserve the right to refuse any order prior to acceptance.

Delivery estimates given are estimates only, and are the responsibility of the carrier.

Pricing

Prices on the website are displayed in UK pounds sterling and are inclusive of any VAT applicable. We can only accept orders and ship goods to the UK mainland.

Prices may be modified from time to time and without notice, but such changes will not apply to Goods in respect of which the Buyer has received an Order Confirmation.

Prices displayed do not include the cost of delivery to the Buyer. Delivery charges are shown separately on the website, though depending on order size and destination, standard delivery may be free of charge.

We endeavour to ensure that all pricing information on the website is accurate. However, if prices displayed on the website are incorrect, we shall not be obliged to sell the Goods at the incorrect price. If we discover an error in the price of the Goods you have ordered, we will inform you of this error and we will give you the option of continuing to purchase the Goods at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.

Cancellation and Returns

Under the UK Consumer Contracts Regulations 2013, you have the right to cancel your order with us within 14 days provided you give us written notice. The cancellation period is up to 14 days from the day your goods are delivered by our courier. There is however no right to cancel contracts for the supply of made-to-order goods.

If you exercise your right to cancel the order within the 14 day period then you must return the goods to us without undue delay and in any event within 14 days of the day you notified us of cancellation.  The goods must be returned to us in perfect, re-saleable condition, with all packaging unopened and nothing written, marked, or stuck on the packaging, this is essential to allow us to return the goods to saleable stock.

On receipt of your notice of contract cancellation, customers service will confirm receipt of you request and give you a returns number to enclose with your shipment. Enclosing the returns number is essential to enable us to process the refund. We recommend that you insure the return shipment as you are under a duty to take reasonable care of the goods and will be liable for damage to them until we receive them at our warehouse. We also recommend that you use a secure, trackable means to return your order to us and that you retain proof of sending, in case of a dispute.  We will refund the full value of your order, including original shipping costs, within 5 working days of receiving your returned goods in perfect, unmarked condition. You will be liable for the return shipping cost.

Faulty Goods

If the goods purchased are faulty, please contact us immediately via the email form on the 'Contact Us' page. If they are then accepted as faulty by us, we will pay the cost of return postage or reimburse the cost of postage and refund the purchase price of the faulty goods. 

Faulty goods must be returned in the condition you received them and you must follow the return process as outlined above.

We will process your exchange or return as soon as it is received however please note that we it can take up to 5 working days for the refund to be processed after receipt by us.

This does not affect your usual consumer rights, including your right to claim a refund or replacement where the goods are faulty. 

General Terms

Access to the website may be suspended, restricted or terminated at any time without notice.

Force Majeure - we will not be responsible for the performance of any obligations under these terms and conditions in the case of an event outside of our reasonable control. 

All notices, which we need to give to you under these terms and conditions will be sent to your registered email address.

These terms and conditions set out the entire agreement between you and us in respect of the sale, purchase and use of the goods. No variations of these terms are binding on us unless agreed by us in writing. If any provision of these terms and conditions is held by the authorities to be invalid or unenforceable in whole or in part, the validity of the other provisions and the rest of that provision shall be unaffected.

The interpretation, construction, effect and enforceability of these terms and conditions shall be governed by English Law, and you and we agree to submit to the exclusive jurisdiction of English courts for the determination of disputes.

Whilst we will use all reasonable endeavours to verify the accuracy of any information we place on the website, we make no warranties, whether express or implied in relation to its accuracy. The website is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the this website, or any transaction that may be conducted on or through the website.

We will not be liable for any damage, loss, destruction or theft of any products once delivered by our courier to your address.

We will not be liable for any indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the website.

We make no warranty that this website will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the website or server are free of viruses or bugs. We will not be responsible or liable for any loss of content or material uploaded or transmitted through the website.

All Intellectual Property relating to the contents of the website belong to either ourselves or to our suppliers. In particular, the trademarks displayed are registered and nothing contained in these conditions or the website should be construed as granting any licence or right to use any of the trademarks without our permission. 

By using the website you agree to refrain from exploiting for commercial purposes any of the website content via any such method as for example, copying, downloading, printing or similar.
